Constitutional Amendment XXVIII

Section 1. No compensation shall be paid to any Senator or Representative for any period during which a Government shutdown is in effect.

Section 2. For purposes of this article, a "Government shutdown" is in effect during any period in which there is a lapse in appropriations for any Federal agency or department as a result of the failure to enact a regular appropriations bill or continuing resolution.

Section 3. No compensation withheld pursuant to this article may be paid retroactively, reimbursed, deferred, escrowed, restored, or otherwise provided to any Senator or Representative for service during a Government shutdown, notwithstanding any other provision of this Constitution or law.

Section 4. This article shall not be construed to vary the compensation of Senators or Representatives in violation of the Twenty-seventh Article of Amendment, but shall instead constitute a specific, narrow exception for periods of Government shutdown as defined herein, effective immediately upon ratification.

Section 5. This article shall apply equally to all Senators and Representatives and shall take effect immediately upon ratification.
